Casino Wars Hit Asia; Not So Friendly, by Greg Tingle - 30th June 2010

Readers er punters, casino billionaires, gaming PR's, journalists, insiders and everyone else... Think casino wars were just limited to the Las Vegas Strip and Australia re Crown Casino VS Star City Casino? Think again. The latest casino war in the Asia Pacific is happening before our eyes in downtown Singapore.

Enter Marina Bay Sands, worth about $5.5 billion and just enjoyed its grand opening on June 23, is the second most expensive casino property in the world and sports 2,560 hotel rooms spread among three towers. (Folks, its 2nd only to CityCenter in Las Vegas, at about $8.5 billion, cost more to build.)

In the red corner...Resorts World Sentosa, which cost "only" $4.4 billion and opened its casino in February. Resorts World Sentosa has four hotels, including the first designed by Michael Graves already open, with 1,350 rooms combined. Two more hotels with 500 rooms are planned. What will be the occupancy rates %, and will the house still always win?

Things work a bit different in Singapore to that in Vegas or Australia.

Fox example locals have to pay through the nose to enter. Local wives can even apply to have their husbands banned from gambling. Stricter dress regulations also... no shorts in the casino thank you.

Marina Bay Sands’ high-roller corridor has restaurants from Japanese-born Australian sensation Tetsuya Wakuda and two Michelin-crowned chefs: Ferran Adria-hater Santi Santimaria of Spain, and Parisian pastry-lover Guy Savoy.

A Pangaea nightclub, sitting on a floating pavilion on Marina Bay is eye catching. Marina Bay Sands has more of a professional (not that type of pro) feel. Corporates are invited by 1.3 million square feet of meeting/exhibition space.

Resorts World Sentosa is more Party Time, with its Universal Studios theme park, easy beach access and lodging options including a Hard Rock and the family-friendly Festive Hotel, offering rooms that can sleep between 6 and 8 people.

Resorts World Sentosa also sports world class chefs and kitchen. Joel Robuchon, Susur Lee, Australia’s Scott Webster and Japan’s Kunio Tokuoka. The complex has been compared to Foxwoods plus.

Table games are all the rage having about double of Marina Bay Sands.
But this high-stakes tussle is just beginning.

Singapore is well aware of the action in Macau as well as Sydney and Melbourne, enjoying recent million dollar revamps, the Lear Jets et al, and are not going to lie down without a fight. The ultimate catch is "whales", and friendly government regulation along with solid relationships are also strategic keys.

The developments unfold as American casino kings such as Steve Wynn talk of moving more of their operation and overall business to the Orient, not overly impressed with the 'O' administration.

Aussie James Packer however is staying on the very good side of Australia state and federal governments, and by all accounts, Macau and his City Of Dreams looks to be enjoining its dream run, after a period of uncertainly.

Swing back to the U.S and Atlantic City isn't looking too good. The industry says AC has failed to adapt to the times very well, and they haven't been able to plug into internet based opportunities as well as many. Maybe some AC casinos could do with the internet consultancy from the likes of Gambling911 and / or Media Man. Basic websites and being listed on Google Earth isn't delivering the world to them.

This fast paced war isn't over yet, but the chess game is well on the way.

Notice of Pre-close Trading Update

PartyGaming Plc, the world’s leading listed online gaming company, will announce a pre-close trading update on 6 July 2010.

Reflecting the fact that the Eurozone has become the predominant economic environment in which the Group’s gaming companies operate based on the currencies with which players fund their accounts, as well as the expected opening of a number of newly regulated regimes in France, Italy and other Eurozone markets, the Group intends to change its functional currency from US dollars to Euros.

In line with International Accounting Standard 21 the change will take effect from the date the Group determined that the characteristics required to identify the functional currency had changed. The Group determined this occurred during 2010 and for accounting purposes, this is effective from 1 January 2010.

In addition, the Group will from this date change the reporting currency used for its financial statements of the Group and other reporting from US dollars to Euros.

All prior financial data will be converted using the exchange rate at 1 January 2010 of 1 US dollar = 0.695 Euros. An updated summary containing the Group’s historic financial data in Euros up to and including the Q1 2010 Key Performance Indicators will be made available at www.partygaming.com on 6 July 2010. The Group’s interim results for the six months ended 30 June 2010 will be reported in Euros when they are announced on 6 August 2010. A separate notification containing details of the analyst presentation and simultaneous webcast and dial-in broadcast for the interim results announcement will be made in due course.

Readers, punters, soccer nuts, media and marketing guns. Thought you had heard the last of ambush marketing aka "parasite marketing"? Think again..
Media Man and Gambling911 are pleased to report that the buxom beer babes who ambushed FIFA are essentially off the hook. This rather welcome news has further inspired a number of Aussie media, marketing and sporting identities who are starting to plan something huge down under in Australia, home of meat pies, kangaroos, Holden Cars (and NRL, AFL, Crown Casino, Star City and Bondi Beach... hint hint). Got the message? Lots of potential targets to throw ya boomerang at. Enjoy ambushing marketing 101, online, offline and everything in between...

Charges were delightfully dropped against the daily double Dutch buxom beer babes (with brains too) who had faced prosecution for allegedly taking part in an ambush marketing stunt at a World Cup soccer match. Oh My God, the crime.

They were among a bevvy of more than 30 Dutch goddess babes who attended last week's Netherlands-Denmark match at the Soccer City Stadium wearing orange mini dresses paid for by Bavaria Beer. The double trouble pair (no, not that pair of knockers er knockouts) were in danger of getting charged under an act that covers ambush marketing aka "parasite marketing", when a firm benefits from an event without paying for advertising! Sounds good hey.

FIFA, whose sponsors have exclusive rights to in-stadium marketing etc, advised some 48 hours ago it had reached a settlement with Bavaria Beer which saw all parties agreed to drop any claims and also not to make any further public comments about the case, but that of course doesn't stop the almost Wikileaks like Gambling911 and Media Man running a follow up (or 3)!

FIFA advised Bavaria now agrees to fully respect FIFA's marketing policies through the year 2022.

A press Statement by the Double Dutch beer babes, Barbara "Buxom" Castelein and Mirte "Melons" Nieuwpoort, read, "We are happy to go home and that the situation has been resolved."

Bavaria remunerated the women to come to South Africa and arranged for them to go to the Netherlands' opening match against Denmark on June 15. Insiders and smart asses reckon Bavaria "won" the encounter, with many admires googling the beer babes "nether regions", only to catch a bit more hot legs action... but they haven't stopped looking, based on stats coming to hand, pun intended.

FIFA officials noted the relatively small "Bavaria" tag on the side of the dresses, which they saw as infringing the rights of official sponsors, partners and the like, some of whom invested multi millions to advertise exclusively at World Cup venues. The dresses are understood to have been available to the public (and potential ambushers) at service stations in downtown Holland, passed "free" with a pack of their now mega famous beer.

Ambush marketing has caused complications in the past for the Bavaria outfit. Circa 2006 - World Cup in Germany, the brewery provided fans orange lederhosen which pissed off FIFA powers that be.

"Buxom" Castelein and "Melons" Nieuwpoort advised FIFA officials and police probed (no not that type of probe you dirty minded loyal readers) them for several hours after the super and successful stunt last week, until legal eagles engaged by the brewery became involved.

As Gambling911 covered last week, a number of Australian marketing and media entrepreneurs are watching this space closely are exploring ideas and potential events to ambush. Australian ambushing marketing king, Kym Illman from Messages On Hold, is keeping his cards pretty well guarded at present, but has made what one may call "strategic leaks" to some media and new media companies, thus already benefiting from some Barvaria - FIFA stunt rub off. Fairfax Media, Markson Sparks!, Harry M. Miller Group, Smart Company, Network Nine, Channel Seven, Crown Casino and Shane Warne are just a few entities that are understood to be watching out for an Aussie ambush marketing stunt follow up. It's also worth noting that long time James Packer friend, Network Nine CEO, David Gyngell has just joined the Crown Limited board of directors. Did we mention Shane Warne is also friendly with Kym Illman and James Packer... ah, what a small world. One that can help put great campaigns together we might suggest.

A Media Man spokesperson said, "We know Aussie marketing king Kym Illman has been watching this space with keen interest. Kym doesn't like to come off as second best, so when he does his next stunt down under, don't be too surprised if it has an impact comparable to the Barvaria buxom beer babes effort at the World Cup. We think the stunt or stunts are likely to happen at either Moore Park, Acer Arena, ANZ Stadium, Bondi Beach or near the Opera House or Harbour Bridge. Possibly a combination. 'Sin City' Sydney is about to become more sinful, thanks to the 'evil genius' Illman, with some help from some friends".

Triggered by a nurse's curiosity over what tipped patients into crisis. The 17% which includes patients referred by mental health crisis teams, is roughly 20 times the rate of problem gambling in the community. Professor Jayashri Kulkarni, director of the Monash Alfred Psychiatry Research Centre, said researchers made the discovery after screening 898 suicidal patients for gambling problems over 6 months last year. Macau SAR is looking at “a missed opportunity” if no direct flights to Australia are launched to replace the Viva Macau operation, the head of the Australian Trade Commission (Austrade) in Hong Kong, Phil Ingram advised. “Obviously people prefer to fly direct and they can’t do that now but it’s not going to stop them from coming”, Ingram says. In fact, the Austrade Senior Commissioner adds, “our biggest export to Macau is tourists. There is a surprisingly large number of Australians coming to visit.” A lot of them, he says, hear about the territory through “the Crown connection.” Crown, Australian billionaire James Packer’s company, partially owns Melco Crown Entertainment, which operates City of Dreams resort and Altira casino. But many more, Ingram believes, “come not just to gamble, but expecting to see something historical and interesting as well as Macau’s UNESCO [United Nations Educational, Scientific and Cultural Organization] World Heritage.” Nonetheless, the Austrade executive emphasised, “we would prefer if there were a new replacement for the airline [Viva Macau].”
“You have a great international airport, so it’s a pity if it’s not used as much as it could be,” he said. The launch of a direct flight to Australia “would be beneficial for our exports too, food most of all,” Ingram acknowledged.

A pyramid scheme offering shares in lottery wins has been banned from operating in the Northern Territory, the Consumer Affairs Commissioner says. Gary Clements says the scheme, known as OzPower System and run by TSC 2000 Europe Ltd, attracts members by offering a share in wins and bonuses for signing new members. Mr Clements says pyramid selling schemes often cost members more than they bring benefits. He says the company has agreed to withdraw from the Territory to avoid court proceedings. "They will basically refuse to accept any further Northern Territory members," he said. "Any current members can withdraw from the scheme without any costs. "There is normally a cost to stop being a member from a lot of these sorts of schemes and they go into detail on their website that Northern Territory residents cannot go into the scheme."

World Cup Refereeing Decisions: History Shows Link Against Aussies!...

3 successive World Cup matches. 3 massive refereeing decisions. Every one against Australia. Conspiracy!!!

a. Fabio Grosso's infamous "dive" over Lucas Neill, which gave 10-man Italy a hotly disputed last-minute penalty to sink Australia's 2006 campaign.

b. The 2010 game opened with Australia's most influential player, Tim Cahill, sent off against Germany for a late but far from malicious challenge, which even the player on the receiving end, Bastian Schweinsteiger, said shouldn't have warranted a red card.

c. Australia's best man on the field, Harry Kewell, is dismissed and suspended for a match after a ball blasted from close range hit him on the upper arm on the goal line in the 1-1 draw against Ghana.

The resultant penalty meant the difference between victory and a draw. The guy has killed my World Cup," said Kewell. "He is the referee, he's the judge, jury and executioner. Crown Casino Aims To Sue Ex High-Roller Client Re $50m Debt, by Greg Tingle - 18th June 2010

Australian casinos do not like clients and former clients who owe them money. Punters er readers might remember a Mr Harry Kakavas aka 'King Of Hedges Avenue', who won big at Crown Casino, and lost bigger. Media Man and Gambling911 play Pink Panther and bring its responsible readership this special report...

Crown Casino plans to bankrupt ex casino high-roller Harry Kakavas, who failed to score victory in court last year. Kakavas, a self-proclaimed pathological gambler, was due to be issued with a bankruptcy notice late last month, after an application by Crown to the Federal Magistrates Court.

High Rollin' Harry was or is a real estate developer by trade, some insiders say "A poor man's Donald Trump", still quite an accomplishment.

At one point 'The King' was one of the world's most successful (or high profile) gamblers in the world, known well to casino tycoon's such as the late, great, Kerry Packer. KP is understood to have one made certain that Crown Casino powers that be, including son James, knew "our friend" Harry.

Mr Kakavas last year was unsuccessful in his bid to sue crown for his alleged losses of a whale whopping $35 million smack a roos.

The recent action comes after a Victorian court dismissed (ruled out) Mr K's multi-million-dollar court action and upheld the casino's $1m counter-claim for the repayment of funds advanced during his patronage to the 'World Of Entertainment', wear Harry appeared to 'Wear The Crown', before he lost it and more.

Mr Kakavas, 43, is appealing against the counter-claim decision.

In a recent appearance before the Supreme Court of Victoria's Court of Appeal, Mr Kakavas's legal counsel advised that his client (Mr K) did not in fact have the funds to meet the judgement debt and would be bankrupt in the absence of a successful appeal. You know, the cliche "loosing the shirt off his back".

His personal debts exceeded $50 million, which may be some kind of record if tested by Guinness (not the beer), with cash, cheques et al owed to multiple casinos and hotels worldwide, along with a swag of ex biz partners, family, friendlies, the Australian Taxation Office... the whole box and dice.

His once ultra successful company, Elite Property Investment Group, is in the grasp of a court-appointed liquidator, thanks to an application by the tax office, while a another casino owner, the Paradise Enterprises, the Bahamas connection, is also attempting to have Mr Kakavas close up shop.

Mr Kakavas hasn't been terrible easy to contact as of late. Speaking appearances are understood to mainly occur in or around court room premises. Mr K could not be contacted earlier this week when press came a calling. His solicitor from last year's Crown Limited, Andrew Joseph of firm Strongman & Crouch, advised Rupert Murdoch owned News Limited he was not representing him on the bankruptcy matter.

An application for get this mouthful "substituted service of bankruptcy notice" doesn't sound pretty), which is generally sought in cases where there are issues in serving a debtor personally, claims that bankruptcy documents were to be sent to Mr Kakavas, care of Mr Joseph's office, on 28th May. Both bankruptcy applications have yet to be "determined" (looked over, ruled on etc) by the court.

Mr Kakavas, was one of Australia's original high-rolling patrons, who also rated considerable on the worldwide unofficial whale ratings weigh in.

"He was the highest of this country's high rollers. And he spread his wings. His gambling took him from the Gold Coast not only to Melbourne, Sydney, Brisbane, Adelaide and Perth, but also to Las Vegas, Hong Kong, Macau and the Bahamas," spoke judge David Harper in his December 8 decision.

"Over a 16-month period he turned over $1.479 billion in Melbourne alone. He enjoyed some spectacular wins. In the end, however, he lost all he won, and more."

Problem Gambler Or Not? We Think We Know...

The Melbourne-born entrepreneur moved to Australia's Gold Coast in 2001 and cemented a name for himself buying and selling property on the ultra exclusive Hedges Avenue patch.

What not everyone knew was that he was also a "problem gambler" of whale like proportions who was self-excluded from many of the worlds casinos, including Packer's Crown in Melbourne, at various times. Circa 1995 saw Harry done for fraud... understood to be linked for his passion for baccarat, also a favorite for James Bond 007 (who has his '56 Aston Martin DB coming up for auction in Red October). Unlike most Bond flicks, Harry's casino dealings don't look to have a happy ending, but will he 'Die Another Day' or one day return to his former kingship ala 'Casino Royale', with or without cheese? ... and wine.

Mr Kakavas had claimed that Crown powers that be were aware of his gambling "disability" (or passion?) and had acted "unconscionably" in luring him ala "hook, line and sinker" (our words, not Harry's) to gamble. That's of course part of Harry's side of the story.

Justice Harper found that while Crown did seek to attract him as a customer... offering him use of its corporate jet at the time (Crown now has 2 or 3 we understand), and hosting him including during the Australian Open Tennis circa 2005, it did not in face exploit his "disability".

We ponder how "disability" played so heavily into the way the cards and diced turned sour for Harry. With thanks to our un met friend (thus far) Jimmy Wales of Wikipedia...

The World Health Organization defines Disability as follows: "Disabilities is an umbrella term, covering impairments, activity limitations, and participation restrictions. An impairment is a problem in body function or structure; an activity limitation is a difficulty encountered by an individual in executing a task or action; while a participation restriction is a problem experienced by an individual in involvement in life situations. Thus disability is a complex phenomenon, reflecting an interaction between features of a person’s body and features of the society in which he or she lives."
An individual may also qualify as disabled if he/she has had an impairment in the past or is seen as disabled based on a personal or group standard or norm. Such impairments may include physical, sensory, and cognitive or developmental disabilities. Mental disorders (also known as psychiatric or psychosocial disability) and various types of chronic disease may also be considered qualifying disabilities.
A disability may occur during a person's lifetime or may be present from birth. A physical impairment is any disability which limits the physical function of limbs or fine or gross motor ability.

Crown Casino is said to be feeling "very able bodied, profitable and confident", according to a fly on the wall at Media Man's Australian office. Chinese whispers from MM's Macau pad are buzzing of the same message.

A Crown Casino spokesman declined to comment as the Harry K VS Crown Limited matter was still before the court.

Mildura Jewel Casino Proposal Still Alive; Gaining Support ...

The proposal by the Mildura Development Corporation to build a land based casino continues to garner community, council, government and news media support. Victorian Premier John Brumby does however advise more paperwork and consultation is required. Casino and property developer John Haddad has secured a letter from Premier Brumby indicating support for his $400 million plan. Brumby's letter restates his position has not changed and that there is no legal restriction on building a casino more than 150 kilometres from Melbourne. He went on record with "Nobody has ever been interested in building one. He's interested. There's no process in place to do it and all I've said publicly is that it would need to enjoy, firstly, strong community support,". Mr Haddad has responded by saying he has not yet been able to meet Mr Brumby to pass on the indications of support he has received. The local council agreed at its latest meeting that the casino presents a major investment opportunity and asked Mr Haddad to prepare more information on his plans. "That's all I needed and that letter is a very strong letter for me to go back to the Premier in addition to the letters I have from the Mildura Development Corporation and the Mildura tourism body," Mr Haddad said.

Internet Censorship - Australia - Asia Pacific - Indonesia - Philippines - Singapore...

Australian and Singaporean Internet-filtering strategies are not appropriate for Indonesia, a blogger says in response to a government proposal to investigate how other countries regulate the web. Singapore has rigid regulations on Internet censorship and imposes heavy criminal penalties on perpetrators, noted blogger Enda Nasution said on Monday. “They can do so because they already have a solid legal infrastructure in place, including [laws] banning pornography and defamation of the government,” he told the The Jakarta Post. “They don’t have freedom of speech in Singapore,” he added. Internet censorship regulations were still under public scrutiny in Australia, he said. Communications and Information Technology Minister Tifatul Sembiring said on Sunday he would seek to limit Indonesia’s access to pornographic web sites. “We need to make the same regulation as Australia, the same as Singapore, but not like China, I think,” he told The New York Times. “I think today the people understand the usefulness of that type of regulation.” The minister’s statement came in the wake of a scandal involving local pop singer Nazril Ilham, known as Ariel, and his girlfriend, actress Luna Maya. A homemade video that allegedly features the pair spread on the Internet earlier this month and was followed by a second sex video that allegedly features Ariel and television presenter Cut Tari. The video has spread across Indonesia and schools have inspected students’ mobile phones for the pornographic videos. The country needs rules that ban negative web content, Tifatul said last week. The ministry previously proposed regulations aimed at filtering multimedia content. The idea died after a public uproar, which included opposition from the burgeoning online community. Critics said the regulation would have killed the content provider industry in Indonesia. “The regulations fatal mistake was that (it made) content providers responsible for content, when the creators, writers or those who upload the content (should be accountable),” information technology analyst Onno W. Purbo said in February. The draft regulation also said that multimedia service providers be banned from distributing, transmitting and making accessible content deemed pornographic or that violated public decency. The regulation also proposed prohibiting online gambling or “carrying lies and misleading information” on the Internet. Content providers who failed to remove such content could have had their permits revoked. Tifatul said that the sex-video scandal was “a good reason” to revive the regulation. Bottom line, internet censorship is a form of censorship, and goes against the free flow of information as described re human rights and the United Nations!

The Indonesian comms and information technology minister said sex videos allegedly featuring celebrities made him "feverish", adding that the country needed a rule to ban "negative" content on the web. In the absence of such a ban, Mi-nister Tifatul Sembiring said he would summon Internet service providers to help stop the spread of the clips, Antara news agency reported. He said he hadn’t seen the video but a report on them from his subordinates made him "feverish". "Why would anyone tape such a private thing?" he said.

Packer is said to be keen to keep his shareholding "low-key" and will keep his stake below the 5% mark at which he needs to formally announce his presence on Photon's share registry as a "substantial shareholder".

Analysts have commented that the investment in Photon reverses a recent trend of Mr Packer selling out his direct equity investment. Last year the king sold his personal stakes in Challenger Financial Services and property group Sunland, as he was starting to hit his straps and prove the knockers wrong again.
